Question on SBRing Rattler

726 Views 7 Replies 6 Participants Last post by  Navy87guy
A Rattler is at the top of my list right now, and my plan is to probably buy the PCB, then Form 1 it eventually. I see the stock for sale on Sig's parts site. How does this work?

Will Sig not let me buy the stock unless I prove I did a form 1? Or am I on the honor system with the ATF that I won't put it on the gun until I get an approved form 1?

You can buy it but you’re not suppose to have it until your form 1 is approved. It would be best if you got the tax stamp and then buy the stock. Some of the rules are fuzzy in this area as far as intent goes.

I think you're looking at Form 4. Form 1 is if you have an existing weapon that you will SBR. You'll need to submit the Seiral # and manufacturing information to the ATF meaning you already have the weapon when dealing with Form 1. I have done 2 SBRs under Form 1 but Form 4 is what FFL and you would use when buying an SBR.

If I bought the gun in PCB form, like I said in my original post, I would already have the gun before I turn it into an SBR. Wouldn't that be Form 1?

Yes you're right.
I used an eForm 1 Individual. Follow/review a YouTube how-to and you'll be good. My first Tax Stamp took 7 days while the second one was 18 days.

While an individual agent could stretch the truth, if you have the stock and it's stored away from the gun then your ok. If it was in the safe with the gun or in the same case, etc then constructive possession would cause you problems.

Order the stock and leave it at a friend's house.
What you’re referring to is “constructive possession”…having the parts to make an SBR that serve no other purpose. It’s a “thing” - but it’s not a crime that the ATF actively pursues. (To my knowledge, there’s never been a single prosecution). That said, it wouldn’t be the best move to buy the stock before the Form 1 approved (which will only take 2-3 weeks). Sig won’t ask, but no sense pushing your luck.
